• Hosting and publishing services for your landing pages
• Analytics and performance tracking features
• Subdomain hosting (e.g., yourproject.checkmarketfit.com)
• Optional custom domain support (on paid plans)

3. Account Registration and Security

3.1 Account Creation

To use our Service, you must create an account by providing accurate, current, and complete information. You may register using your email address or through third-party authentication providers (e.g., Google).

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Notify us immediately of any unauthorized use of your account
• Use a strong, unique password for your account
• Not share your account credentials with third parties
• Maintain accurate and up-to-date account information

3.3 Account Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use our Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

5. User Content and Intellectual Property

6. Subscriptions and Payments

6.1 Free and Paid Plans

We offer both free and paid subscription plans. Free plans may have limitations on features, templates, or usage. Paid plans provide access to additional features and higher usage limits.

6.2 Billing

If you subscribe to a paid plan, you agree to pay the applicable fees as described on our pricing page. Fees are charged in advance on a recurring basis (monthly or annually, depending on your selection). All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

6.3 Price Changes

We reserve the right to modify our pricing at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. We will notify you of any price changes in advance.

6.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will continue to have access to paid features until the end of your billing period.

7. Service Availability and Modifications

We strive to provide reliable and continuous access to our Service, but we do not guarantee that the Service will be available at all times. We may:

• Perform scheduled maintenance that may temporarily interrupt service
• Modify, suspend, or discontinue features or the entire Service at any time
• Update or change the Service to improve functionality or security

9. Termination

9.1 Termination by You

You may terminate your account at any time by deleting your account through your account settings or by contacting us.

We may suspend or terminate your account and access to the Service immediately, without prior notice, if you:

• Engage in fraudulent, illegal, or harmful activities
• Fail to pay applicable fees (for paid plans)

9.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account, User Content, and published landing pages. We are not obligated to retain or provide you with copies of your content after termination.

10. Disclaimers and Limitation of Liability

10.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

10.2 Limitation of Liability

To the maximum extent permitted by law, Check Market Fit and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

10.3 Maximum Liability

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Check Market Fit and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Delhi, India, without regard to its conflict of law provisions.

12.2 Dispute Resolution Process

If you have a dispute with us, you agree to first contact us to attempt to resolve the dispute informally. If we cannot resolve the dispute within 60 days, you agree to resolve the dispute through binding arbitration, except for disputes that qualify for small claims court.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Check Market Fit regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
